• “Lender” (Private Lender, P2P Platform, Financial Partner) – Licensed private lenders and P2P financing platforms receiving loan leads from us.
• “Services” – Our lead generation and matchmaking service connecting SMEs with lenders.
• “Website” – Our online platform where users submit inquiries and access our services.

2. Our Role & Services

• We do NOT provide loans, financial advice, or broker deals.
• We do NOT negotiate loan terms or guarantee approvals.
• We simply collect and pass loan inquiries (leads) from SMEs to licensed lenders and P2P platforms.

How It Works

• SMEs submit a financing request via our website.
• We pass the request to verified lenders (no hidden fees, no loan sharks).
• Lenders contact SMEs directly to discuss financing options.
• We charge lenders a commission on closed loans.

3. User Eligibility & Responsibilities

(a) SMEs (Business Owners Seeking Financing)

• You must be at least 18 years old and legally eligible to apply for business financing in Malaysia.
• You confirm that all information provided (business details, financials, contact info) is accurate.
• You understand that submitting a request does NOT guarantee financing.
• You acknowledge that lenders, not us, will set all loan terms, including interest rates and repayment schedules.

(b) Lenders & P2P Platforms

• You must be a legally registered and licensed financial entity in Malaysia.
• You agree to handle all leads in compliance with Malaysian financial laws.
• You acknowledge that we do NOT guarantee lead conversion or loan approvals.
• You will NOT misuse lead data for spam, unauthorized marketing, or illegal purposes.

4. Fees & Commissions

(a) For SMEs

• ✅ Our lead generation service is free for SMEs.
• ✅ Any loan-related fees will be disclosed directly by lenders, not us.

(b) For Lenders & P2P Platforms

• ✅ We charge a flat fee per lead and commission on successfully closed loans.
• ✅ Specific commission terms will be outlined in a separate agreement.

5. Data Privacy & Consent

• By using our services, you agree to our Privacy Policy and consent to data collection, processing, and sharing as outlined.
• SMEs understand that their information will be shared with lenders for financing evaluation.
• Lenders agree to handle all lead data responsibly and comply with Malaysia’s Personal Data Protection Act (PDPA).

6. Disclaimers & Limitation of Liability

• We are not liable for any financial losses, damages, or disputes arising from financing obtained through our platform.
• SMEs must conduct their own due diligence before accepting any loan offer.
• Lenders are responsible for their own risk assessment when evaluating leads.

(c) No Financial, Legal, or Investment Advice

7. Termination of Services

We reserve the right to suspend or terminate any user’s access to our services if they:

• Provide false or misleading information
• Violate these Terms & Conditions
• Engage in fraudulent, unethical, or illegal activities

8. Intellectual Property

• All content on our website (text, images, branding, software, etc.) is owned by GrowKawkaw.com and protected under copyright laws.
• Users may NOT copy, distribute, or use our content for commercial purposes without written permission.

9. Governing Law & Dispute Resolution
